This is a textbook performance of structural violence. A 69-year-old industry power player, facing allegations from two children aged 7 and 8, is set free because the prosecution failed to 'fairly instruct' the grand jury on witness requests. Note the absurdity: the judge isn't concerned with whether the children were groped, but whether the prosecutor acted in an 'impartial manner' regarding the paperwork.
In Galtung's Violence Triangle, this is structural violence at its peak. The law is weaponized into a complex terminology game; a minor procedural flaw is used to convert direct violence into a sterile debate over 'legal process.' When the judge writes that the prosecutor 'failed to act in a fair manner,' he is using 'procedural justice' as a shield to mask a deeper meta-violence: the absolute dominance of an adult male director/producer over the bodies of children in a closed set hierarchy.
This dismissal is not a victory for justice, but a result of systemic complicity. The production set, the legal system, and the label of 'lies' attached to the accusations form a biological wall. The children's expression is dismissed as a lie, while the power player's expression is validated as 'innocence.' The most cynical part is the judge's note that the state could 'pursue new charges'—essentially telling Busfield: you won this round because the other side messed up the forms; we can gamble again next time.
The Actual state of this game: the predator is free, and the victims are objectified once more by the law. The gap between Potential and Actual is the true price of this dismissal.
