The Litigant's Game: Using 'National Importance' as a Shield Against Evidence

Lawsuits are weaponized as power performances, and legal procedures become bunkers for the privileged.

This is a classic game of fighting for the right of interpretation. Trump's $10bn lawsuit is never about seeking just compensation through legal channels; it is a weaponized expression. By suing, he drags the BBC into a battlefield where he defines the rules, manufacturing a narrative of being 'unfairly treated.'

However, when the legal process reaches the core of the discovery phase—the deposition, where one must face factual evidence—the face of privilege is revealed. His lawyers use the grand narrative of 'matters of national importance' to dodge the court. This is a textbook manifestation of meta violence: by binding his identity to 'the State,' he attempts to place himself above the common rules of civil society. In the mind of the privileged, the law should be a sword to attack others, not a chain to constrain himself.

The BBC's situation reveals a facet of structural violence: even in systems boasting the rule of law, procedural justice is diluted by this kind of identity politics when power is sufficiently concentrated. The privileged enjoy the PR dividends of filing a suit while dissolving the opponent's legal capacity through stalling tactics. The logic of 'I can sue you, but you cannot question me' is essentially a monopoly over the interpretation of the law.

If the judge ultimately allows him to evade deposition based on such excuses, this legal gamble will once again prove that in the face of power, facts are secondary. The only scale that determines victory is the power to define what constitutes a 'matter of importance.'
