It reduces judicial procedures—which should require public debate and rigorous scrutiny—into a mere administrative shortcut. When the Trump administration uses this method to rapidly push agendas like mass deportations and the erasure of transgender rights, the law ceases to be a scale for balancing power and becomes a conveyor belt for its realization. This mechanism of ruling "without lengthy explanation" provides the perfect cover for meta violence: achieving structural exploitation of the marginalized without disturbing the facade of formal legal justice.
An even more cynical form of complicity is found at the dinner table. While Justice Jackson warns law students that this practice is corroding public trust, three of her colleagues—including Chief Justice Roberts—are dining at the White House with Trump and President Xi. This social alignment reveals a dangerous dynamic within the Supreme Court: while some play the performative role of "guardians of the law," others have already entered the complicity field of the power core. They trade their nods in the shadows for seats in elite social circles.
Jackson's critique is precise, but in a system where the right of interpretation is monopolized, such internal dissent is often dissolved into a decorative "diversity of opinion." When judicial review is bypassed by an end-run, the gap between the actual state of the law and its potential justice—the core of the Violence Triangle—is widened.
