Specialist Courtrooms: Surgical Tool or Expensive Band-Aid?
England and Wales are introducing "specialist courtrooms" for rape cases, featuring private entrances and fixed trial dates. In terms of the Violence Triangle, this is an attempt to reduce the gap in the direct layer—preventing survivors from being re-traumatized during the legal process. On a physical level, this is progress.
But we must ask: is this a structural victory? Optimizing the physical space of a courtroom does not fix the underlying judicial logic. Claire Waxman hit the nail on the head: the backlog is worsening. When tens of thousands are waiting, a few "luxury rooms" are merely privileges for a lucky few, while the masses remain trapped in structural violence. Without a systemic increase in efficiency, these courts are a gimmick—a visible hardware patch for an invisible systemic collapse.
The irony is that this "progress" relies on individual women, like Charlotte Nichols, waiving their anonymity and using their trauma as leverage. In the existential war, this is a brutal trade: women must perform a form of self-sacrifice to prove the system's failure, while the system uses the narrative of their "bravery" to close a PR loop. This "bravery" narrative is itself a form of cultural violence; it transforms institutional failure into individual moral glory, easing the guilt of the legislators.
Good news is defined by the actual narrowing of the gap between Potential and Actual. If these courtrooms don't lead to a substantive rise in conviction rates, but merely make survivors more comfortable while they are denied justice, then this is just a complicity of "decency," not a revolution of justice.
