The performance by Meta, TikTok, and X in court is strikingly consistent: they don't challenge the law itself, only the "implementation details." In corporate speak, this is called proportionality; in power dynamics, it is weaponized litigation. By creating endless legal friction over minutiae, they successfully transform structural violence into a technical debate over interpretation.
The Online Safety Act aims to shrink the gap between Potential and Actual—liberating users from the violence of algorithmic manipulation and fraudulent ads. Yet Meta's logic is that if regulatory costs affect a percentage of global revenue, this "unjust" calculation is itself a form of violence. It is peak irony: a giant that profits from monopolizing cognitive entry points and objectifying user attention suddenly demands "precision" and "justice" when facing a 10% fine.
This is fundamentally a war over pricing power. Ofcom seeks to establish regulatory costs through fines; Meta seeks to reduce those costs to zero through judicial review. When Meta claims this is a "normal feature of a new regulatory regime," it masks a cold reality: it is using its deep-pocketed capital to turn legal procedure into a biological wall, keeping regulators at bay.
This complicity extends beyond tech giants to a transatlantic political narrative. The alignment between the Trump White House and US tech firms upgrades this legal battle into a clash of sovereign narratives. But regardless of the packaging, the core objective remains: ensure the algorithmic black box stays opaque, and ensure the predation of data by capital comes without a real price tag.
