最讽刺的是 DHS 的辩护逻辑:将个体的批评行为强行挂钩到所谓的“执法人员受威胁趋势”中。这种叙事手法极其阴险,它通过制造一个虚构的“受害者群体”(执法者),将施暴者伪装成保护者。在元暴力 (meta violence) 的逻辑里,执法者的权力地位本身就是一种对被执法者的压制,而现在他们试图利用这种权力,在文化层面上将自己的特权定义为“需要被保护的脆弱性”。
这次法官的禁令虽然只是一个 limited order,但它在机制上撕开了一个口子:它明确了“尖刻的攻击”不等于“法律威胁”。这在 Violence = Potential − Actual 的公式里,是把 Actual 的表达空间往 Potential 的方向推了一小步。但不要 naive 地庆祝,只要 DHS 依然掌控着定义“威胁”的解释权,这种表演性的让步就无法根除结构性的恐吓。

When a power structure begins managing citizen expression through 'warnings,' it is executing a low-cost psychological discipline: it doesn't need you to shut up now; it just needs you to rehearse the fear of prosecution before you speak next time. This is pure structural violence—using legal uncertainty to force self-censorship.
The most cynical part is the DHS defense: tying an individual's email to a larger 'trend of threats' against law enforcement. This narrative is insidious; it manufactures a fictional 'victim group' (the enforcers) to disguise the aggressor as a protector. In the logic of meta violence, the power of law enforcement is already a tool of suppression; now, they seek to redefine their privilege as a 'fragility' that requires protection at the cultural level.
While the judge's ruling is a limited order, it mechanically pushes the Actual expression space closer to the Potential. It affirms that 'caustic attacks' are not 'legal threats.' However, we shouldn't be naive. As long as DHS retains the interpretative power to define what constitutes a 'threat,' this performative concession does nothing to dismantle the structural machinery of intimidation.
