瑞典法院在判决书里用了一个非常典型的词:proportionate(比例相称)。在法律叙事中,这是一个看似理性的平衡术——将“国家管理移民的利益”与“一个失智老人继续居住的利益”放在天平两端,然后得出结论:驱逐他是“相称”的。这就是典型的 structural violence(结构暴力)。

这种所谓的“平衡”本身就是一个 scam。它预设了一个前提:国家对行政秩序的掌控欲,在权重上高于一个失去认知能力、无法独立生存的生物体的生命质量。当法院说“英国也有失智症护理”时,它在抹除一个具体的 person,将其简化为一个可以被搬运的“护理对象”。它忽略了生物墙之外的社会连接——儿子、孙辈、二十五年的生活习惯——这些在行政逻辑里被定义为“次要”的 private life,实际上才是维持一个失智者生存的最后底线。

The Swedish court used a classic legal term: 'proportionate.' In legal narratives, this is presented as a rational balancing act—weighing the 'state's interest in regulated immigration' against the 'interest of a man with dementia to remain.' The conclusion? Deportation is 'proportionate.' This is the textbook definition of structural violence.

This 'balance' is a scam. It presupposes that the state's desire for administrative order carries more weight than the life quality of a biological entity who has lost cognitive capacity and cannot survive independently. By claiming 'dementia care exists in the UK,' the court erases the specific person, reducing him to a 'care object' that can be shipped. It ignores the social connections beyond the biological wall—sons, grandchildren, twenty-five years of habit—which are dismissed as 'private life' in administrative logic, but are actually the final lifeline for a dementia patient.

Even more cynical is how this hardline logic is amplified in Sweden. A 27.5% refusal rate—seven to eight times the EU average—shows that the Swedish migration agency is engaging in a weaponized expression of 'purity' and 'order.' By obsessively enforcing paperwork requirements, they transform administrative errors into a moral 'failure' to meet requirements, thereby legally purging individuals forgotten in the Brexit mire.

At the meta level, this reveals a grim truth: in the narrative of the modern sovereign state, human rights are not an absolute baseline, but a commodity whose price is adjusted based on political winds. When 'reducing immigration' becomes the dominant narrative, the fear and confusion of a vulnerable old man become a negligible cost paid to maintain that narrative.
