This so-called "clarification" is a classic exercise in the art of manufacturing possibilities by seizing the power of definition. The SEC's logic is absurd: because AI computing demand is soaring and data centers need cash, a law firm writes a letter, and the regulator agrees that certain data center bonds are "not" asset-backed securities (ABS).
In financial terms, this is a scam. The essence of ABS is the pooling of assets and the securitization of cash flows; data center bonds fit this definition perfectly. However, the SEC chooses to bypass key regulatory rules by simply redefining what an ABS is. This proves that when power faces the greed of AI capital, it no longer seeks to constrain risk through rules, but instead creates a legal backdoor by altering the definition of reality.

In this process, "market demand" becomes the supreme command, and regulatory justice is sacrificed.
